These terms govern your use of the YourWind website, Spot and associated services. By using these services, you agree to comply with these terms.
Purpose of the service
Spot brings together observations, forecasts and local context to help riders assess conditions. The service may evolve, and some features may vary depending on location, device or data availability.
Weather conditions and safety
Wind, weather, tide and current data, alerts and community reports are provided for information only. They may be incomplete, inaccurate, delayed or unavailable. They do not replace your judgment, official advisories, local rules or an on-site assessment. You are responsible for your safety, your equipment, your decisions and compliance with applicable closures, access restrictions and regulations.
Accounts
You must provide accurate information, protect your login credentials and notify us of any unauthorized use. You are responsible for activities carried out through your account.
Community contributions
You retain your rights to the content you publish. You grant YourWind non-exclusive permission to host, reproduce, make technical adaptations to and display that content to operate and promote the services. You confirm that you have the right to publish the content and that you respect the privacy of others. We may moderate or remove content that is misleading, dangerous, unlawful or contrary to these terms.
Acceptable use
You must not bypass security measures, disrupt the services, access accounts or data without authorization, publish content that is unlawful, misleading, abusive or infringes the rights of others, or use the services in a way that endangers people.
Intellectual property
Unless otherwise indicated, the trademarks, interfaces, text, graphics and software of YourWind and Spot belong to YourWind or its licensors. No licence is granted beyond the limited right to use the services in accordance with these terms.
External services
Some data and features are provided by third parties. Their availability and accuracy may depend on those providers, and their own terms may apply.
Availability and changes to the service
We may correct, modify, suspend or remove a feature, including for maintenance, security, compliance or product development reasons.
Limitation of liability
To the extent permitted by law, the services are provided without any guarantee of continuous availability or accuracy. YourWind is not responsible for a decision based solely on data displayed in Spot. Any rights that cannot be excluded by law remain fully applicable.
Termination
We may restrict or suspend access in the event of a breach of these terms, a security risk or a legal requirement. You may stop using the services at any time.
Governing law
These terms are governed by the applicable laws of Québec and Canada, subject to mandatory consumer protections.
Changes to these terms
We may update these terms. The last-updated date will identify the version in effect. Continued use after a change takes effect constitutes acceptance, to the extent permitted by law.
